Zo zijn er zorgen over...Show moreDoor de jaren heen hebben verschillende discussies in het land de spanningen bloot gelegd tussen bestuurders van regionale samenwerkingsverbanden en gemeenteraden. Zo zijn er zorgen over besluitvormingsprocessen en is er kritiek op de legitimiteit van het regionaal bestuur. In dit onderzoek worden aanbevelingen gegeven die legitimering van regionale samenwerkingsverbanden doen vergroten. Daarbij wordt de vraag beantwoord in hoeverre bestuurders invloed kunnen uitoefenen en welke factoren nog meer van belang kunnen zijn. Regionale samenwerkingsverbanden kunnen uit verschillende soorten regelingen bestaan. De mate van legitimiteit is afhankelijk van wat soort regeling het is. Wil je de betrokkenheid, en zo ook de legitimering vergroten, kan je als raad ervoor kiezen om voor een soort regeling te kiezen waar raadsleden ook in participeren. Wanneer gekozen wordt voor een collegeregeling is het van belang de raad bij de voorbereiding goed mee te nemen. Het betekent dat je als gemeenteraad goed moet nadenken per samenwerkingsverband wat voor soort regeling dit moet zijn. Naast de verschillende verschijningsvormen van regionale samenwerkingsverbanden, is de mate van samenwerking en de manier waarop de governance is ingericht ook van belang voor legitimering van besluitvorming. Het is belangrijk dat raadsleden weten wat hun instrumentarium is. Daarnaast komt naar voren dat griffiers een cruciale taak hebben als het gaat om meer regio in de raad te krijgen om zodoende betrokkenheid te vergroten. Wanneer het gaat om de governance kan een regionale prioritering worden gemaakt, waarna gestalte gegeven kan worden aan regionale experteams, waarbij per gemeenten raadsleden worden afgevaardigd. Het gebruik van de theorie van de two level game en de toepasbaarheid op de regionale en lokale arena, heeft ervoor gezorgd dat er een beter beeld is ontstaan van de invloed die bestuurders kunnen hebben op de legitimering van bestuurlijke besluitvorming. De theorie van two level games zegt dat het van belang is dat zowel op lokaal als regionaal niveau de uitkomsten van onderhandelingen goed worden begrepen. Diegenen die als linking pin hierin acteren zijn de bestuurders. Bij het acteren in de lokale en regionale arena is het van belang dat bestuurders zich laten voeden met informatie vanuit de raad en regelmatig een terugkoppeling geven aan de raad. Zij vergroten hiermee de democratische legitmering door de raad een versterkt gevoel te geven van controleerbaarheid.Show less

However there have also been links made between populism’s effect on an individual’s trust in institutions. Considering the contemporary importance of international organisations and the rise of populism, we seek to understand the effect populism has on trust in international organisations. We make use of the European Values Study to our two hypotheses. We find that populists are predicted to have a lower degree of trust in the European Union and United Nations compared to non-populists. Moreover, we find that populists’ trust in international organisations is expected to increase when a populist party is in government, compared to only being in opposition. Our findings suggest that populism poses a challenge to the continued legitimacy of international governmental organisations, and policymakers should seek to continue fostering greater public confidence.Show less

In order to give adequate responses to a...Show moreIn an increasingly globalized world, international organizations remain important to coordinate the need for global cooperation and collective action. In order to give adequate responses to a plethora of wicked problems, international organizations need to be given more sovereignty and decision-making powers. This clashes directly with the need of national governments to retain their sovereignty. These clashes can lead to a decrease in legitimacy for the IO and give rise to nationalism, and in the most extreme cases to democratic backsliding. Democracy promoting IOs unintentionally help democratic backsliding in member states when they do not design proper democracy promoting tools and mechanisms. I mix process tracing and discourse analysis to look at the influence of democracy promoting mechanisms of IOs on member states who experience democratic backsliding. I demonstrate my case by looking at the application and results of the conditionality mechanism of the EU on Poland and Hungary. The conditionality mechanism focuses mainly on 1) constitution, 2) rule of law, 3) civil and minority rights, 4) the independence of the judiciary and the media, and 5) the separation of power within government. Of these, I focus on the effects of the conditionality mechanism on 4) the independence of the judiciary and the media. I find that the conditionality mechanism mainly influenced changes in the independence of the judiciary. This influence was also seen back in the resilience and recovery proposals from Hungary and Poland, where both countries pledged to pass legislation to increase the independence of the judiciary. Right-wing...Show moreThe influence of right-wing populist ideology on governments has increased over the past two decades and these developments are still ongoing in several countries over the world. Right-wing populist politics is often characterized by values of anti-pluralism and anti-elite, which threaten diverse, inclusive, and open societies. These influences in the form of populistic pressures may lead to democratic backsliding and can have far-reaching consequences on the administrative apparatus and political-administrative relations. Top civil servants as main actors within the democratic constitutional state and the civil service are important in safeguarding day-to-day governance and in dealing with populistic pressures and preventing democratic backsliding. This research, therefore, focuses on the perceptions and expectations of top civil servants regarding which strategies and actions a government with a populistic signature will adopt and subsequently the response of civil servants to these pressures. The findings show that the absolute majority of top civil servants expect that a government with a populist signature will adopt strategies and actions about centralization of both structure and resources and regarding the politicization of both norms and personnel. Furthermore, most top civil servants are neutral regarding their expectations of whether civil servants will respond. They consider it most likely that civil servants will resign, closely followed by speaking out against the policy. They find it more likely that civil servants will have a response than not respond, and finally, expect that civil servants will not be loyal to a populist government when dealing with populistic pressures.Show less

In Nederland staan zelfstandige bestuursorganen (ZBO) op afstand geplaatst van een ministerie. Verschillende auteurs claimen dat er een toenemende mate van politisering is binnen ministeriële bureaucratieën (Christensen, 2012; Peters en Pierre, 2004: 1; Eichbaum en Shaw, 2013; Van der Meer et al., 2007: 41). Binnen dit onderzoek worden beide onderwerpen, politisering en zelfstandige bestuursorganen, aan elkaar gekoppeld en onderzocht. Dit heeft geleid tot de volgende onderzoeksvraag: ‘In welke mate is er sprake van politisering bij de benoeming van bestuurders bij zelfstandige bestuursorganen van verantwoordelijke ministeries?’. Het onderzoek van Hustedt en Salomonsen (2014), waar verschillende vormen formele en functionele politisering worden aangeduid, is gebruikt als basis voor dit onderzoek. Binnen het kwantitatieve onderzoek zijn in totaal 63 zelfstandige bestuursorganen onderzocht en 302 bestuursleden die actief zijn binnen deze zelfstandige bestuursorganen. Ook de aanwezige vormen, en in welke mate politisering aanwezig is binnen zelfstandige bestuursorganen is onderzocht. De onderzoeksresultaten laten zien dat binnen de verantwoordelijke ministeries van zelfstandige bestuursorganen een verschil zit in de mate van politisering. Van formele politisering is binnen een zelfstandig bestuursorgaan en dus ook de verantwoordelijke ministeries geen sprake. Functionele politisering speelt in meerdere mate een rol bij ZBO’s die zich binnen grote maatschappelijke en dus politieke vraagstukken bevinden en in mindere tot geen mate bij specialistische ZBO’s die onder specialistische ministeries vallen. Functionele politisering is op te delen in twee componenten; de eerste component van functionele politisering is ‘Politieke ervaring’. Hierbij zijn per ministerie verschillen te ontdekken, maar deze variabele speelt geen significante rol binnen de onderzochte zelfstandige bestuursorganen. De publieke werkervaring van de bestuursleden speel wel een significante rol bij de benoemde bestuursleden.Show less

Het kan bijvoorbeeld te wijten zijn aan ineffectief leiderschap op basis van een mismatch in de coherentie en samenstelling van het bestuur. De besturen van menig overheidsorganisatie op afstand bestaan namelijk uit een mix van bestuurders met een publieke en private achtergrond. Sommige bestuurders komen uit het bedrijfsleven, andere uit de overheid, politiek of maatschappelijk middenveld. Sommige bestuurders zijn op en top expert op een vakgebied, maar hebben een andere opleiding genoten dan hun medebestuurders. Deze verschillende achtergronden van bestuurders kunnen zijn uitwerking hebben op de teamprestaties van de bestuurlijke top. Dit kan in zowel positieve als negatieve zin. Diversiteit in teams binnen de publieke sector kan namelijk leiden tot een correcte afspiegeling van de samenleving, met meerdere perspectieven en dus een uitgebreidere overweging van vraagstukken. Maar diversiteit in teams (op basis van hun professionele achtergrond en de ervaring die zij hebben opgedaan binnen de private of publieke sector) zou ook kunnen leiden tot bijvoorbeeld een verschil in individueel leiderschap(gedrag) die niet in overeenstemming is met de leiderschapsstijlen van andere leden van het bestuur. Of dit leidt tot conflicten, en in het ernstigste geval tot bestuurlijk falen, is de vraag. In deze scriptie staat de volgende vraag dan ook centraal: In hoeverre heeft professionele diversiteit (binnen bestuurlijke teams) invloed op bestuurlijk falen? Het onderzoek zal worden opgezet aan de hand van triangulatie. Er wordt namelijk gebruik gemaakt van kwalitatieve en een kwantitatieve dataverzamelings- en analysemethode in de onderzoeksopzet. Er wordt kwalitatief inductief onderzoek gedaan naar literatuur betreffende leiderschap(sstijlen) (in de publieke sector), verschillen tussen publiek en privaat leiderschap en literatuur met betrekking tot diversiteit in teams en wat dit voor uitkomsten heeft op de teamprestaties. Vervolgens wordt hieruit een hypothese opgesteld. Daarnaast is het een casestudie, omdat er een documentenanalyse wordt uitgevoerd naar de misstanden in het verleden bij het Commissariaat voor de Media (CvdM) en de Nederlandse Zorgautoriteit (NZa). Dit geschiedt aan de hand van “process tracing” in kranten, maar ook middels het bestuderen van documenten van onderzoekscommissies. Deze twee voornoemde marktautoriteiten worden kwantitatief onderzocht door middel van interpretatie en analyse in een dataset waarbij gegevens gebruikt worden van huidige en vorige bestuurders binnen de organisatie die gecodeerd zijn op basis van opleidingsachtergrond en of zij eerder in de publieke of private sector hebben gewerkt. Deze professionele achtergronden van bestuurders van de NZa en het CvdM (waarbij bestuurlijk falen is geconstateerd) worden onderzocht op een zekere diversiteit of juist complementariteit op het gebied van opleiding- en loopbaanachtergrond. Vervolgens worden deze data vergeleken met de data van een 12-tal andere marktautoriteiten (waarbij geen bestuurlijk falen is geconstateerd). De samenstelling van de bestuurlijke toppen bij deze marktautoriteiten (op basis van de individuele professionele achtergronden van huidig en oud-bestuurders binnen de organisatie) worden vergeleken met de besturen van de NZa en het CvdM. Op basis van vergelijking tussen data van deze besturen, en of er overeenkomsten of juist verschillen worden geconstateerd, wordt duidelijk of er een correlatie bestaat tussen professionele diversiteit binnen bestuurlijke teams en bestuurlijk falen.Show less

Niet eerder is de nevenfunctie als onafhankelijke variabele centraal gesteld wat mogelijk de kans op benoeming bij een publieke organisaties vergroot. Uit de literatuur blijkt dat er meerdere factoren van invloed kunnen zijn op de benoeming van een bestuurder bij een publieke organisatie, zoals party patronage, waarbij een benoeming van een bestuurder beïnvloed wordt door de politieke affiliatie van die bestuurder (Ensser-Jedenastik, 2016a). Daartegenover stelt Van Thiel (2009) de X-factor, waarbij de benoeming van een bestuurder beïnvloed wordt door het complete palet aan skills, competenties, kennis, politieke sensitiviteit en voormalige functies. Door Peci en De Araujo (2020) zijn de gehele loopbanen van Braziliaanse toezichthouders in kaart gebracht om te achterhalen welke achtergronden bestuurders hebben en hoe dit hun verdere carrière beïnvloed. Om de relatie tussen nevenfuncties en de kans op benoeming te onderzoeken is kwantitatief en kwalitatief onderzoek verricht. Allereerst zijn alle nevenfuncties van bestuurders die aan Nederlandse marktautoriteiten van 1976 tot 2020 zijn verbonden in kaart gebracht, gecodeerd en geanalyseerd. In het kwantitatieve deel van het onderzoek worden een aantal verwachtingen geanalyseerd. Deze verwachtingen zijn in het theoretisch kader geformuleerd op basis van de aanname dat nevenfuncties een indicator zijn van het sociale netwerk en deskundigheid van een bestuurder wat de kans op benoeming bij een publieke organisatie vergroot. Het onderzoek en de nevenfuncties zijn thematisch onderverdeeld in de grootte van het sociale netwerk i.e. het aantal nevenfuncties en de invloed hiervan op benoeming en de deskundigheid i.e. het aantal nevenfuncties wat overeenkomt met de taken van de bestuurder of de marktautoriteit en de invloed hiervan op de benoeming van een bestuurder. Een tweede aspect van deskundigheid wordt gemeten aan de hand van het aantal voorzittersnevenfuncties. Van deze specifieke nevenfuncties wordt verondersteld dat zij een indicator zijn van managementskills, wat Van Thiel (2013) als een onderdeel van deskundigheid beschouwd. De resultaten van het onderzoek geven een genuanceerd beeld weer waarbij de grootte van het sociale netwerk van invloed kan zijn op de kans op benoeming, maar waar dit kan verschillen per organisatie, per jaar waarin de bestuurder benoemd wordt en of de bestuurder herbenoemd zal worden. Met betrekking tot de deskundigheid van de bestuurder is er ook sprake van een genuanceerd beeld, waarbij de bestuurders van enkele organisaties een hoger aantal overeenkomende nevenfuncties dragen dan andere organisaties. Daarnaast wordt waargenomen dat het aantal inhoudelijke overeenkomende nevenfuncties de kans op herbenoeming (tot 2 herbenoemingen) kunnen vergroten. De nevenfuncties van bestuurders kunnen de kans op benoeming bij een Nederlandse marktautoriteit vergroten, maar dat hangt af van de specifieke context waarbinnen de bestuurder benoemd zal worden.Show less

As the Global ...Show moreSince WWII, the influence of IOs has increased where virtually all issue of global concern is administered by an IO. However, this influence has not come without its hazards. As the Global “Governance Dilemma” theorizes, it is because of it that member states wish to ‘capture’ their decision-making and power-distribution apparatuses —their voting systems— to better realize their agendas. The case studies of two prominent IOs, the IMF and the UNSC, provide support that it is often true that these systems favor powerful member states due to a politicization of their voting systems. To address the potential causes and shortcomings of this phenomenon, this thesis conducted an in-depth case study of the institutional designs —Virtue Cultivation, Political Autonomy, and Meritocracy— of the Colombian Political Party MIRA that were born out of their unique theoretical framework of Miraísm. Through the implementation of these designs, this party successfully overcame obstacles akin to the ones that IOs face, despite their small size and the prevalence of corruption in Colombia. Building from this, the thesis followed a standard method of theory generation to create a novel framework regarding how to better resolve the core issue at hand: The Aligned Interests-Goals (AIG) Theory. In essence, this theory postulates that through specific institutional designs that tie A (self-interests) and B (goals) together by offering C (incentives) that provide the obtainment of A in exchange for proven efforts regarding B can effectively nudge behavior towards a virtuous cycle of positive competition for their mutual satisfaction. Based on the logic of this theory, the thesis delivered its main institutional proposal of Incentives-based Meritocratic Voting Systems as an alternative design to avoid the adverse consequences of politicized voting systems in IOs, while leaving prospect for the avoidance of absolute insulation from powerful member states, therefore increasing the probability for effective results regarding IO goals of intergovernmental cooperation, sacrifice, and change.Show less
