Specifically, I will examine his theory of justice in holdings and its...Show moreIn this thesis, I will discuss Robert Nozick’s entitlement theory of justice as developed in his Anarchy, State, and Utopia. Specifically, I will examine his theory of justice in holdings and its three constituent principles of justice in acquisition, justice in transfer, and the principle of rectification. The core focus of this thesis is, however, on Nozick’s principle of rectification, which ties his entitlement theory together. As part of this analysis, I will also explore questions concerning how far back one must and can go, what a victim may require as rectification for an injustice, and various other complications that cannot be simply ignored in the face of practical real-world applications. Specifically, I will consider the injustice of slavery as it existed in the United States from its foundation in 1776 up until 1865, when the Thirteenth Amendment proclaimed that “neither slavery nor involuntary servitude, […] shall exist within the United States, or any place subject to their jurisdiction.” For the injustice of slavery during this time period, I will provide an empirical and data driven analysis to quantify the requisite Nozickian rectification. Having examined the question of how large rectification for slavery ought to be, I conclude that it should be minimal or nil if the question is analyzed under Nozickian libertarian principles. My conclusion is based on (a) a review of the conceptual problems with claims for rectification, and (b) an empirical analysis that provides a rough estimate of how much claimants can possibly expect to receive for rectification.Show less

Het grootste aangenomen voordeel van een dergelijke auto is dat deze het aantal verkeersslachtoffers aanzienlijk kan verminderen, doordat het menselijke fouten elimineert. In deze scriptie wordt de volgende onderzoeksvraag behandeld: “is de komst van volledig zelfrijdende auto’s onwenselijk, ondanks het bijkomstige voordeel dat daardoor het aantal verkeersslachtoffers kan worden verminderd?” Volledig zelfrijdende auto’s kunnen in situaties terecht komen waarin een ongeluk onvermijdbaar is en het maken van verkeersslachtoffers onvermijdelijk. Deze no-win-situaties zorgen voor een ethisch dilemma; wie moet de auto bij verschillende potentiële slachtoffers aanrijden? In het eerste hoofdstuk bespreek ik verschillende ethische principes die in een zelfrijdende auto kunnen worden geprogrammeerd. De volgende principes worden besproken: consequentialisme, egoïsme, willekeur, knop-optie en Kantiaans. Gebleken is dat elke optie voordelen, maar zeker ook nadelen heeft. In het tweede hoofdstuk worden overkoepelende argumenten besproken, daarin wordt beargumenteerd dat een zelfrijdende auto fundamenteel onwenselijk is. Onder andere bevatten sommige systemen een targeting algoritme. Dit betekent dat een specifieke groep mensen het doelwit wordt bij een ongeluk. Dit is een vorm van discriminatie en is zowel moreel onwenselijk alsook in strijd met de wet. Ook blijkt de toepasbaarheid van zelfrijdende auto’s in de werkelijkheid nog behoorlijk wat haken en ogen te hebben. Op basis van het onderzoek kom ik tot slot tot de conclusie dat een volledig zelfrijdende auto, ondanks het verminderen van het aantal verkeersslachtoffers, niet wenselijk is.Show less

Schools of intrinsic value like deep ecology have been found extreme in the past, their implications undesirable to humans. External perspectives like anthropocentric value judgements, for example ecosystem-service arguments, or considerations of intergenerational justice have become increasingly common and well researched. However, this thesis starts from the observation that anthropocentric value based morality does little to protect ecosystems for their own sake. Instead, it merely focuses on those parts that either appeal, service, or otherwise are useful to humans. It is especially this perception of ecosystems that lies at the root of current and past exploitation of the ecosystem. The result is nearly irreversible damage to the ecosystem. This thesis argues for pro tanto moral rights for the ecosystem, on the basis of interest-based moral considerability. I will show that previous arguments for or against the moral considerability of nature lack sufficient knowledge of ecological processes. If ecological processes are properly understood, the ecosystem can be said to have an interest. This interest, or wellbeing, is the striving towards homeostasis. This means that the ecosystem has moral considerability and is a moral patient. It is therefore eligible for moral rights. These rights-relations occur between moral agents and moral patient when there is contact. This will be explained through developing the Contact-Theory.Show less
