In deze scriptie zal ik de these onderbouwen dat Heidegger met zijn denken zelf echter nog met een been in dit einde staat en Nietzsche op zijn beurt blijk geeft al verder te zijn dan dit einde en een vermoeden heeft van de nieuwe richting die Heidegger met zijn denken inslaat, zonder deze nieuwe weg nog vanuit zijn eigen denken te kunnen begrijpen. Dit in elkaar overlopen van het einde van de eerste aanvang en begin van de andere aanvang, deze overgang waar zowel Heidegger als Nietzsche deel aan hebben blijkt uit hun ervaring van dát ogenblik, waarin de mens in een verhouding staat met de onverborgenheid van het zijnde, waarbij het zijnde zich kan tonen zoals het op zichzelf is en als zodanig door de mens ervaren kan worden zodat er sprake is van waarheid. Heidegger heeft toegang tot deze waarheid vanuit zijn begrip van waarheid als onverborgenheid, maar ook voor hem is het onmogelijk om te weten of het zijnde zich daadwerkelijk toont zoals het op zichzelf is, of slechts als schijn. Equal respect for dignity is one of those important democratic principles, therefore I focus on the principle dignity and its relation to freedom of speech. Dignity commands recognition respect which means recognizing the equal authority and accountability of people. I argue that statements without any free speech interests can be restricted. Statements that contain valuable and harmful aspects can be restricted when the harm upstages the value. This is when the statement harms the essence of dignity and negates the relational aspect of freedom of speech.Show less

Dit wordt in de regel...Show moreDe kwaliteit van de therapeutische relatie in psychotherapie, de persoonlijke band tussen de therapeut en de patiënt, blijkt erg bepalend voor het behandelresultaat. Dit wordt in de regel onderscheiden van technieken, als zijnde alle manieren waarop klachten, gedragingen en herstel begrepen worden en al de interventies die hieruit volgen. Deze scriptie beschrijft drie benaderingen die de kracht van de relatie in onderscheid van technieken pogen te verklaren, vanuit de stellingname dat het belang van de relatie relevant is voor de verantwoordelijkheid die de therapeut ten overstaan van de patiënt heeft. Door gebruik te maken van verschillende plaatsen die door filosofen aan de ethiek zijn toegekend, worden verschillende mogelijkheden zichtbaar. De faciliterende relatie, ten eerste, leert dat de kracht van de relatie gelegen is in haar ondersteuning van de technieken. De atechnische relatie, ten tweede, stoelt op Bubers begrip van de ethische tussenruimte en beschrijft de relatie op haar krachtigst wanneer technieken slechts een geminimaliseerde rol spelen. De asymmetrische relatie, ten slotte, stoelt op Levinas’ begrip van de ethiek als eerste filosofie en leert dat de confrontatie met een ander oproept tot verantwoordelijkheid en dat dit (in beide richtingen) de kracht van de therapeutische relatie verklaren kan. Deze laatste benadering wordt als de meest plausibele verklaring voorgesteld. Deze enactivisten verwerpen hiermee de gangbare opvatting in de cognitiewetenschappen dat cognitie het best kan worden begrepen als het verwerken van mentale representaties. Het probleem van het enactivisme is dat het succesvol wordt bevonden in het begrijpen van online cognitie zoals waarnemen, maar niet in het begrijpen van offline cognitie, zoals bijvoorbeeld herinneren en verbeelden. In hoeverre dit opgaat heb ik onderzocht door waarnemen, net als Varela, Noë en Gibson, te operationaliseren als sensorisch geleide act. Daarna heb ik de veronderstelling van Gibson getoetst die stelt dat herinneren en verbeelden kunnen worden begrepen als het offline in werking treden van sensomotorische contingenties van bepaalde sensorisch geleide acts die al eigen zijn gemaakt. Aan de hand van een fragment uit het dagboek van Cocteau laat ik zien dat procedureel en episodisch herinneren nog goed kunnen worden begrepen als sensorisch geleide acts, maar semantisch herinneren, oftewel herinneren bemiddeld door externe representaties niet. Ook voor verbeelden geldt dat die vormen die worden bemiddeld door externe representaties niet goed kunnen worden begrepen als sensorisch geleide act. Om deze vormen van offline cognitie ook te kunnen begrijpen in termen van sensorisch geleide act moeten ze worden begrepen als tweede-orde sensorisch geleide act.Show less

The overarching aim is to determine the extent to which Sade’s conception of transgression in The 120 Days can illumine the problem of sovereignty. The thesis will argue that this novel presents a sustained revelation of a particular paradox evident in sovereign theory. This paradox is explicitly dealt with in the political philosophy of the German jurist Carl Schmitt (1888-1985). It is the contention of this thesis that the political philosophy of de Sade, as outlined in The 120 Days, contains precise affinities with Schmitt’s theory of the exception. Like Schmitt, Sade articulates the transgressive capacity of sovereign power. Sovereignty rests upon mere attribution, not moral or normative considerations. Sovereign authority, once attributed, is legitimate because the sovereign has the power and authority to decide that it is legitimate. This ‘decision’ creates our paradox: the transcendent preserver of law is ultimately not bound to the law that is ordered. Consequently, the sovereign power alone is capable of legitimate transgression, going beyond the normal order with the aim of sustaining the normal order. Any suspension of law on behalf of the sovereign is an act of transgression. In the suspension of law, the sovereign transgresses the limits of the juridical order, with the aim of sustaining the legal order, hence the paradox. This thesis will focus on The 120 Days of Sodom as a philosophical novel about the possibility of absolute sovereignty. In the ‘real world’, the suspension of law sustains the juridical order, the transgression ultimately serving a practical purpose which is to uphold juridical normalcy. In Sade’s fictive space, however, he details no such bounds. The 120 Days is a wildly destructive exercise; it imitates the justification of sovereign power found in the decision to create a situation of infinite transgression of boundaries and limits. Sade forms an impossible universe wherein the exception becomes a normative principle. Sade accelerates the principle of sovereign power – the decisionistic aspect of the law – portraying seemingly endless attempts to sustain the “miracle” moment.Show less

A...Show moreIn this thesis the unreasonable effectiveness of mathematics in the natural sciences is discussed. I will show that this is a deep philosophical problem for which no easy solution is available. A historical analysis of the role of mathematics in science shows that basic mathematics, an abstraction from empirical observation, evolved into complex mathematics, a human invention completely detached from its empirical roots. The conclusion of this analysis is that the applicability of mathematics cannot be explained by adhering to the empirical roots of mathematics. This poses a philosophical problem: how can something that is anthropocentric describe and predict the intricate workings of natural phenomena so accurately? This question is my main research question and is also thoroughly discussed by Mark Steiner (1998). He places emphasis on the predictive power of mathematics in the natural sciences and I will show that Steiner’s main argument, that anthropocentric elements in mathematics play a crucial, and unreasonable effective, role in the discovery of new physical theories is a valid observation in need of an explanation. The mapping accounts of Pincock (2004) and Bueno and Colyvan (2011) are discussed, who attempt to render the anthropocentric elements in mathematics intelligible. They both turn out to be incomplete and therefore, I have provided an improved inferential mapping account that is able to render parts of the anthropocentric influences in mathematics intelligible. However the successful use of tractability assumptions cannot be explained by this mapping account. This leads to the conclusion that the world looks ’user-friendly’, because our anthropocentric assumptions result in correct knowledge about the natural world. Therefore, one cannot refrain from a metaphysical discussion about the relation between mathematics, mind and world. I discuss several metaphysical accounts, of which the most reasonable is the simple explanation that we just ’see what we look for’. A price needs to be paid however; complete knowledge about the world around us will never be possible. Moreover, it remains mysterious that we are able to control natural phenomena in such a detailed way, whilst only having knowledge of a small part of it. The final chapter mentions the changing role of mathematics in science in the last 30 years, where advancements in theoretical physics increased the importance of mathematical methods, whereas advancements in computer science decreased this role. I conclude that now more than ever, it is important to reflect on the role of mathematics in the scientific method.Show less

A renowned Dutch lawyer, Professor Paul Scholten (26th of August 1875 – 1th of May 1946) argues that religious existentialism in combination with a system of law appeals to the personal responsibility of a judge as well. This personal responsibility is existential or metaphysical and refers to the decision of Abraham at Mount Moría in the book by Søren Kierkegaards titled ‘Fear and Trembling’. Professor Scholten wrote several important works on religious existentialism and the personal responsibility of a judge; according to Professor Scholten, personal responsibility is in the core of how to speak justice. In this thesis, the thoughts of Professor Scholten constitute the connection between the scientific and philosophical approach of the law.Show less

These criteria...Show moreHow should we think about causation in the law? Traditionally, the law distinguishes two kinds of criteria for legal causation. First, there are criteria to establish cause in fact. These criteria are applied to determine whether there is a factual causal connection between the agent’s behavior and another event. Second, there are criteria to establish the adequate cause. These criteria are applied to determine whether a cause in fact is a salient cause for the law. I argue that the criteria for cause in fact are insufficiently specified in traditional legal theory. The criteria for cause in fact are implicitly contrastive, but lack an account of the admissibility of the contrasts. I develop distinct accounts of the admissibility of the contrasts for tort law and criminal law, and argue that rather than ask whether the effect would still have occurred in the absence of the defendant’s behavior, the law requires us to ask whether lawful behavior by either the defendant alone or by all agents involved, as specified by the plaintiff or prosecutor, would have prevented the effect from occurring. It follows that legal relevance considerations determine the contrasts underlying the criteria for cause in fact and that the cause in fact/adequate cause distinction in the law cannot hold. Furthermore, I argue that the traditional criteria for adequate cause should limit legal responsibility for some outcomes of the contrastive causal analysis, but do not play a role in this analysis. Therefore, the traditional criteria for adequate cause should not be considered part of the concept of legal causation.Show less
