First, by reviewing the current...Show moreThis research examines if and to what extent the Bosphorus case and Opinion 2/13 have shifted the applicable jurisdiction away from the ECtHR and towards the CJEU. First, by reviewing the current literature on Bosphorus and Opinion 2/13. Second, by analysing on an individual basis if and to what extent both cases have shifted the applicable jurisdiction away from the ECtHR and towards the CJEU. Finally, this research concludes that only the Bosphorus case has shifted the applicable jurisdiction away from the ECtHR and towards the CJEU. Furthermore, this research concludes that with issuing Opinion 2/13, the CJEU made sure that the applicable jurisdiction would remain with the CJEU. The research ends with the observation that the EU is still required to accede to the EU and therefore, the CJEU has to make amends to eventually make it possible for the EU to accede to the ECHR.Show less

Hierbij wordt de ongelijke relatie tussen patroon en cliënt bedoeld, waarbij de patroon de cliënt verder helpt in zijn carrière. In deze bachelor scriptie wordt het belang van deze patronagenetwerken in de vroegmoderne tijd bekeken en onderzocht met behulp van een case-study. De carrières van twee hooggeplaatsten VOC-dienaren worden hierbij onderzocht. Willem Van de Graaff was gouverneur van Ceylon in 1785-1794 en zijn broer Cornelis was gouverneur van de Kaap in 1785-1791. Beide broers zouden onterecht ontslagen zijn en door vijanden ten val zijn gebracht. Met behulp van secundaire literatuur en archiefstukken uit het Nationaal Archief wordt getracht de carrières en het ontslag van beide broers in kaart te brengen en de gebeurtenissen in context van de patronagenetwerken te plaatsten.Show less

Na de herdenkingscultuur van geallieerde bombardementen in Nederland te hebben behandeld, aan de hand van de bombardementen op Den Haag, Nijmegen en Amsterdam, kon dit worden getoetst aan de hand van een case study over het geallieerde bombardement op Breskens. It goes in a phrase by Tsun Zu as, “to know your enemy, you must become your enemy.” During the periods of colonization, the Dutch authority in Dutch East Indies (now Indonesia) had reflected such ideas through its language policy. This policy established in 1818 and was intended to exercise the colonial authority by utilizing the language. The departement voor Inlandsche Zaken was established in order to connect the domains of the indigenous and colonial government in Dutch East Indies. By this, the agency was obliged to study the language and culture in the archipelago. During the first five years of the Inlandsche Zaken, it had showed remarkable achievements in the unification of local vernaculars and the standardization of Malay. In this paper, I will provide several analyses on translation of documents from the archives of the Inlandsche Zaken kept at the National Archives of the Republic of Indonesia. By this, I will examine the differences between two similar documents-each documents contains Dutch texts and they are translated into Malay (Dutch texts in these two documents are similar but the Malay translations are different) produced by the Dutch colonial government. My central research question is, to what extent language was utilized as a tool of subordination towards the indigenous society in Dutch East Indies? In addition, I try to demonstrate that the Inlandsche Zaken had played a determinant role in bridging the two worlds in Dutch East Indies-namely the colonial government and the indigenous societies, and also had used such knowledge to exercise the colonial authority.Show less

Anderen beweren juist dat er géén sprake is van genocide in de antieke wereld. Er zijn verschillende casussen waarbij grote groepen mensen bewust gedood zijn, maar van genocide kan in de Oudheid niet gesproken worden. Zowel bij de vernietiging van Carthago, het antisemitisme en de christenvervolgingen ontbreekt het in de Oudheid aan een extreem vijandbeeld dat gericht is tegen de fundamenten van een groep. Daarnaast ontbreekt het in de Oudheid aan een gecoördineerd plan om de vernietiging in werk te stellen. In de moderne tijd waren beide elementen wel sterk aanwezig en het verschil kan verklaard worden door bepaalde condities die niet in de Oudheid aanwezig waren. Het ontbreken van het eerste element kan verklaard worden uit de opkomst van de homogene natiestaat en de verschillende biologische rassentheorieën in de 19e eeuw. De biologische redenatie zorgt voor een motief en rechtvaardiging van een nieuw concept, de vernietiging van een groep die de superieure homogeniteit bedreigt. In de Oudheid bestonden er nog geen biologische rassentheorieën en leefde men in rijken waar uniformiteit geen streven was. Het ‘onveranderlijke’ idee van een groep gebaseerd op de fundamentele karaktertrekken bestond nog niet en concluderend heeft een genocidaal vijandbeeld niet tot ontwikkeling kunnen komen in de Oudheid. Het ontbreken van het tweede element kan verklaard worden uit de logistieke efficiëntie die een genocide vereist maar wel in de 19e en 20e eeuw.Show less

Both sides raided and skirmished to control strongholds on the major rivers (Rhine and Waal) and to encircle Utrecht. The final offensive of the count was a chevauchee of almost 3000 horses, which forced the Bishops surrender in June 1356. The forces collected by the count were mostly from Guelders and Holland but also from other principalities which bordered the great rivers. Their interest in trade and tolls is likely to have been a key factor to explain their involvement.Show less

Much less attention is given to economic history, more specifically history of economic policy. This thesis examines the relationship between the economic policy and the continuity of Indonesian state during the revolution period. It analyzes how the state built its policy, what the policies were and what the implications were for the country development. I argue, despite there is a belief that considers the revolution period is “a history no change”, several economic policies had an impact to the state within the decolonization framework.Show less
