It looks at two specific areas, namely guardianship procedures and inheritance law. The research focusses on an urban setting, using two case studies (Leiden and Leuven). The findings are placed in a comparative context by comparing them with results for other cities in the Low Countries, as well as the findings of other medievalists for different countries (England, France and Italy).Show less

In this thesis, the existence of such thoughts are explored in the...Show moreIn the discussion on identity, there is a strong tendency to limit the existence of national sentiments to the modern period. In this thesis, the existence of such thoughts are explored in the letters of three ruling families from the late fifteenth century: the d’Este, Gonzaga and Sforza. The letters have been scrutinized from several perspectives, eventually indicating both the existence of an idea of Italy and its limited application in the political realm. As for the letters in material sense, they show great similarities in their composition, suggesting a common cultural horizon. This is no great surprise, as these ruling elites were socially strongly intertwined through marriages and friendships. From the ongoing discussion on the state of the war, there speaks a strong awareness of a common Italian interest. The expression of this awareness, however, occurred in such a way that underwrites personal interest and the preservation of the own state. In this sense, the political importance of the idea of Italy was constituted by the accumulated interest of the princes in the peninsula. But, because personal interest eventually always prevailed, it was simultaneously also its limitation in the political realm.Show less

In dit onderzoek wordt...Show moreSinds de aanslagen van 9/11 is maritime security een buzzword in internationale diplomatiek. De term heeft echter geen betekenis en is daardoor vrijelijk te interpreteren. In dit onderzoek wordt getracht deze term te concretiseren door het functioneren van de Staten van Zeeland tussen 1467 en 1506 op maritiem vlak te bestuderen. Hieruit blijkt maritime security drieledig te zijn. Conflictpreventie, bescherming ter zee en kustverdediging zijn onderwerpen die veelal op dagvaarten van de Staten van Zeeland werden besproken. Deze onderwerpen staan in dit onderzoek centraal. Voor het eerst in meer dan vijftig jaar worden de Staten van Zeeland weer onderzocht, waarbij het belang van deze regio in de interregionale en internationale context wordt geplaatst. Dit levert nieuwe inzichten op in niet alleen de positie van het Zeeuws gewest in de late Middeleeuwen, maar ook op de impact van grote historische ontwikkelingen op regionaal niveau.Show less

Zijn jarenlange verblijf in Londen,...Show moreNoël de Caron (1550?-1624), was de eerste ambassadeur van de Verenigde Nederlanden in Engeland (1609-1624), die tot op heden nog nauwelijks bestudeerd is. Zijn jarenlange verblijf in Londen, van1590 tot aan zijn dood in 1624, maakte hem tot een prominente inwoner van de stad, uitzonderlijk goed verbonden met de Engelse politieke elite, met de internationale calvinistische gemeenschap, en met de Nederlandse kooplieden-handelaars in de stad. Zijn sociale, culturele en religieuze inbedding in de Londense samenleving is het uitgangspunt voor mijn onderzoek naar zijn functioneren als ambassadeur: hoe beïnvloedde deze inbedding zijn functioneren? Was het een voordeel, een nadeel, of wellicht beide? Aan de hand van drie case study's beschrijf ik het verband tussen inbedding in een gastland en het functioneren van Caron specifiek, en een vroegmodern ambassadeur in het algemeen.Show less

Deze ongelijkheid had gevolgen in de diplomatieke praktijk, ambassadeurs...Show moreIn de zeventiende eeuw werden staten fundamenteel ongelijk geacht aan elkaar en gerangschikt in een onderlinge hiërarchie. Deze ongelijkheid had gevolgen in de diplomatieke praktijk, ambassadeurs eisten voorrang, genaamd ‘precedentie’, op ambassadeurs van staten die lager in de hiërarchie stonden. Wanneer een ambassadeur meende dat hij en daarmee zijn staat ten onrechte een rang werd ontzegd kwam hij in protest en werd de rang met argumenten verdedigd. Argumenten die in de praktijk gebruikt werden hadden drie brede criteria als grondslag: 1) titel en aard daarvan, bijvoorbeeld anciënniteit van de dynastie; 2) Gods zegen, bijvoorbeeld bezit van het ware geloof en goede werden voor de kerk; en 3) traditie: de geschiedenis van precedentie. Deze criteria en de bijbehorende argumenten waren afkomstig uit interne machtslegitimering van monarchieën en impliceerden katholiek koningschap. Zowel katholicisme als een monarchale staatsinrichting ontbraken bij de Republiek wier argumenten toch naar dezelfde criteria werd getoetst. Uit analyse van correspondentie tussen Nederlandse diplomaten in Frankrijk en de Staten-Generaal kunnen we concluderen dat ook de Republiek alle drie de soorten argumenten gebruikte in de verdediging van haar beoogde rang. Traditie was het belangrijkst en ook het makkelijkst te produceren sinds de erkenning van de soevereiniteit van de Republiek door Hendrik IV van Frankrijk in 1609. Gods zegen kwam ook terug in verschillende vormen maar argumenten naar het titel-criterium waren moeilijker te vormen en werden niet succesvol ingezet. De oorsprong van de Nederlandse argumenten was net als bij monarchieën interne legitimering van macht en staatsvorm. Echter door de 'vertaalslag' die de diplomaten van de Staten-Generaal moesten maken om hun argumenten gehoord te krijgen werd die oorsprong wat meer naar de achtergrond geduwd.Show less

Until the Empire’s demise in 1806, its two supreme courts adjudicated disputes that stemmed from all levels of the imperial hierarchy. Despite considerable autonomy, a sizable army and international ambitions, the rulers of Brandenburg-Prussia remained accountable to imperial justice. The Kings ‘in’ Prussia needed the emperor’s confirmation to realize their expansionist ambitions in the Southern German region of Franconia. The Reichshofrat, as the emperor’s supreme court, reviewed the lawfulness of Prussia’s claims, while a political opposition of small Franconian princes organized itself around the influential imperial arch-chancellor and elector of Mainz. The opposition feared Prussian interference in their regional assembly and did everything to prevent Prussian expansion into Franconia. Several of the king’s relatives were persuaded to join the opposition and appeal to the Reichshofrat to challenge Prussia’s ambitions. This ignited an intra-dynastic conflict which could alter the balance of power in the Empire on the outset of the 18th century. This thesis enquires how the Reichshofrat arbitrated the conflict, demonstrates how political and legal issues merged in a struggle for power and seeks to understand how the protagonists operated within the confines of the Empire’s legal framework. As they tried to achieve their political objectives within the imperial system they were forced to deal with its constraints. The conflict’s dynamic, course of events and outcome were determined by the imperial system.Show less

By differentiating punctually and thoroughly adequate between the religious rulings of the scholars, the policies of the rulers, and daily reality of the people, it enables one to understand these three phenomenons as entities, but within their inter-complemantary context. As a result, it made it possible through literary evidence to distinguish between the written formality as laid down in the fiqh-literature, and daily reality as lived by all people. Between these two a discrepancy is often to be observed, which means that the question whether The Islamic law of Andalusia was tolerant cannot homogeneously be answered. Alternatively, to answer the question whether Islamic law of Andalusia concerning non-Muslims was tolerant, one is to decide which touchstone he or she is using. Furthermore, this thesis reserves likewise a focus on the eschatological motivations behind the seemingly mundane character of the rulings concerning non-Muslims, a focus which is still too poorly integrated in academic works.Show less
